Privacy Statement

Privacy Statement (September 2022)

 

This privacy statement outlines the obligations of Leaves of Nurture Ltd It outlines your rights as a member. Please take your time to read through the whole contract. This agreement includes the data responsibilities under the General Data Protection Regulation which came into effect on 25th May 2018.

 

Responsibilities of Leaves of Nurture Ltd in order to comply with the new regulations regarding contact and consent, we need to make you the member aware of your rights and confirm that you give consent (by agreeing to become a paid member) for Leaves of Nurture Ltd and any relevant professional parties mentioned to collect and store your data in the way described below. 

 

Leaves of Nurture Ltd will collect and store your information that is collected in your initial membership sign in, this could be name, date of birth, age, next of kin, doctors and medication and any other assessment information given. This is basic information that helps us to get to know you better but is also stored for lawful and safeguarding purposes (see confidentiality/ sharing of information statement). 

 

Your Address, Email address and phone number is recorded and stored as a means of contacting you regarding your membership. We will usually contact you using the preferred method firstly but if we can’t reach you, we will try a different method that you have given us. Bank details are kept for payment of membership purposes only and linked to contact for payment purposes only.

 

These details may also be used for emergency purposes where there is an evident risk of harm to yourself. GP details are recorded for safeguarding purposes. Whereby if we have cause concern for your Well-being and safety, we may have to contact your GP, Mental Health Team or The Police. Medical notifying diseases will be done, if you have not done, under Government requirements. Where possible we will seek to get your consent and/or inform you before doing so. 

 

Question notes, will possibly be kept, are very brief anonymous notes of key themes discussed in our correspondences. The purpose of recording this is for our own recollection and to monitor the work we are doing and also may be needed to be retained for lawful purposes. Incident forms are done when there are incidents and will be kept on our file.

 

Confidentiality/sharing of information

All information collected and shared will not be shared with anyone else unless it is agreed, for safeguarding or is required by court.  The payment collection will have their own terms of business.

 

We will not sell your information and we will not use it for any purposes other than those related to your membership or agreed contact by Leaves of Nurture Ltd 

 

There are however exceptions that may require me to share your information with a third party, details of which are outlined below. Please note that a decision to breach confidentiality is not taken lightly and all due consideration to your privacy is taken into account. Confidentiality may need to be breached in the following circumstances:

There is significant risk of harm to yourself, in this instance information may need to be shared with a GP or other professionals.

If there is information that needs to be shared that suggests a child/vulnerable adult is being harmed or is at risk of harm. In this instance information may need to be shared with relevant services. 

If there is disclosure of terrorism or money laundering or sex slavery we are legally obliged under the terrorism and money laundering act, slavery act to disclose this information to the police without your knowledge or consent. 

Finally, if we are subpoenaed by court to share any information then I must do so upon that request. Safeguarding a client will be our priority. 

We may at times share concerning information, work with a supervisor who is a qualified counsellor and adheres to the same confidentiality and privacy requirements. All information shared is anonymous to avoid identification. This is for our learning and development and requested by the membership organisation. 

 

In the event of the death or terminal injury resulting  Leaves of Nurture Ltd unable to carry out  continued work, a nominated person, whom is a qualified counsellor who also adheres to the same confidentiality requirements, will be in contact if work is being done with you. Supervisor will have access to all the clinical records in order to inform clients and end therapy and destroy data as required. If this occurs to another person from  Leaves of Nurture Ltd will act accordingly. 

 

Data storage and Disposal

All data at Leaves of Nurture Ltd is recorded on paper format and is stored in a locked filing and cabinet. We keep your first name as reference. We may have data on a password protected hard drive laptop due to email correspondences. 

 

If you contact us by phone by call or text contact numbers are stored on the passworded phone using your first name. This is deleted on completion of services. 

 

The length of time we will store data varies, throughout the duration of therapy we will keep all records. Once Therapy has terminated, we will keep your address and contact details in a file, as well as session notes for a further 5 years for adults and until 19years of age for a child in line with the insurance policy and legal obligations. 

 

Your Rights 

Under General Data Protection Regulations, you have the following rights:

The right to be informed about the collection and use of your personal information as described herein.

The right to access copies of any information held about you, this can be accessed through a data subject access request, and the right to receive a response to this request within a period of no more than 1 month. 

The right to rectification; to have inaccurate personal data rectified or completed If incomplete.

The right to erasure; you have the right to opt out of data collection. If you wish to do so please make this request in writing, however some data can not be erased and will need do be retained for lawful purposes and In  line with our insurance policy.

The right to Data portability. You have the right to obtain and reuse your personal data for your own purposes across different services. 

Finally, you have the right to object to any personal data being collected, this will need to be made known in advance or at the start of any membership commencing. 

Please note if this is the case all therapeutic work will be terminated as we are required to keep appropriate records in line with my insurance and ethical Bodies as well for legal and safeguarding matters.

 

 

Accessing your data

If you wish to make a request for your data under a data subject access request please do so in writing. We will request you to sign a disclosure consent form. You will then expect to receive the information within 30 days of receipt of the request.
